Please read these Terms & Conditions carefully. By opting into the any text notification or subscription with Onyx Monarch LLC or partners off Onyx Monarch LLC SMS service, you agree to be bound by these terms.

1. Program Description

Onyx Monarch LLC provides daily fishing reports, weather updates, and localized insights, and general notifications via SMS. These reports and notifications are intended for informational and entertainment purposes only.

2. No Age Restriction

There is no minimum age requirement to subscribe to this service. However, if you are under the age of 18, you represent that you have obtained permission from a parent or legal guardian to subscribe and incur any potential messaging charges.

3. User Opt-In & Frequency

By providing your number and opting in through our website or by texting our keyword, you provide express written consent to receive recurring automated text messages. Message frequency is 1 message per day for any report service and as needed or requested for notification services. Consent is not a condition of purchase.

4. Fishing Success & Liability Disclaimer (The "No Fish" Clause) Specifically for Fishing Report Partners. 

Gramps Fishing Reports provides data based on current conditions, historical patterns, and third-party reports. We do not guarantee that you will catch fish.

  • No Warranty: Fishing is subject to numerous variables outside of our control (e.g., skill, equipment, sudden weather changes, fish behavior).

  • Limitation of Liability: You agree that [Your Business Name] and its owners shall not be held liable for any lack of fishing success, equipment damage, or personal injury resulting from your reliance on our reports. You use the information provided at your own risk.

5. Cost of Service

Onyx Monarch LLC does not charge a separate premium fee for receiving these texts beyond your standard subscription price for clients purchasing a report or service from partners. Direct clients of Onyx Monarch LLC will be charged for text services based on agreement terms when Onyx Monarch LLC is the managing entity of the texting service. However, for customers utilizing products and services of Onyx Monarch LLC and partners, message and data rates may apply from your mobile carrier. You are responsible for all charges levied by your wireless provider.

7. Carrier Disclaimer

Mobile carriers are not liable for delayed or undelivered messages. We do not guarantee that messages will be delivered 100% of the time as network outages can occur.
